Kollective Khaos Dance — Terms of Service (Draft)

This agreement explains your rights and responsibilities when you use our website, buy credits or memberships, book classes or events, or visit our studio. Please read it carefully.
1. Agreement to terms
By accessing or using our site or services, you agree to these Terms. If you do not agree, do not use the services. We may update these Terms from time to time. We will post the updated version with a new effective date. Material changes will be highlighted.
2. Who we are
These Terms are between you and Kollective Studios Inc., operating as Kollective Khaos Dance in Waterloo, Ontario, Canada.
3. Eligibility and accounts
You must be able to form a binding contract in your place of residence. If you are under the age of majority in Ontario, a parent or legal guardian must consent and accept these Terms on your behalf. You are responsible for maintaining the security of your account and for all activity under it.
4. Bookings, attendance, and cancellations
- Booking: Book through your account using available credits, memberships, or direct payment.
- Attendance: Please arrive on time and follow instructor guidance and studio rules.
- Cancellations by you: You may cancel within the time window shown at booking (typically at least 2 calendar days before the scheduled start).
- If you booked with credits: Eligible cancellations return the same number of credits you used (e.g., 1 for a drop-in; if a session required 3 credits, 3 are returned).
- If you paid by card: Eligible cancellations do not refund to your card. Instead, we add 1 studio credit per upcoming class in the booking to your account (e.g., a 3-week session that has not started returns 3 studio credits). Studio credits have no cash value.
- Late cancellations / no-shows: Cancellations after the cutoff may be ineligible for any refund or credit.
- Cancellations by us: We may cancel or reschedule a class or event, for example due to low enrollment, instructor illness, or safety. If we cancel, we will refund the relevant credit or fee, or add an equivalent credit to your account.
5. Credits and credit packs
Credits are for booking eligible classes or services. Credits are non-cash, non-transferable, and not for resale. Expiry periods and other rules are shown at purchase and in your account. Expired credits cannot be used.
Studio Credit: A studio credit equals the value of one drop-in class booking that can be applied to eligible classes as displayed in your account. Studio credits are issued for card-paid cancellations under Section 4 and have no cash value. Studio credits may have the same expiry rules as regular credits unless otherwise stated.
6. Memberships and subscriptions
- Auto-renewal: Unless stated otherwise, memberships renew automatically each billing period using your saved payment method.
- Managing your membership: You can cancel renewal at any time before the next billing date in your account settings. Access continues until the end of the paid period.
- Changes: We may change pricing or features on renewal. If we make a material change, we will notify you in advance.
- Failed payments: If a payment fails, we may suspend access until the payment issue is resolved.
7. Pricing, taxes, and refunds
Prices are shown before checkout and are subject to applicable taxes. Except where required by law or our posted policy, purchases are final. We may offer goodwill credits at our discretion.
For class cancellations initiated by you, refunds and credits are provided under Section 4. If you paid by card and cancel within the permitted window,no refund is sent back to your card; instead, we issue 1 studio credit per upcoming class in the booking. If you booked with credits, we return the same number of credits you used. If we cancel a class, we will refund the associated credit or card payment, or add an equivalent credit to your account.
8. Health, safety, and assumption of risk
Dance and fitness activities involve physical exertion and carry a risk of injury. By participating, you confirm that you are in suitable health and that you will follow instructor guidance and safety rules. You assume all ordinary risks associated with participation. If you have health concerns, consult a qualified professional before participating.
9. Studio rules and conduct
Treat instructors, staff, and other participants with respect. Follow posted rules, including attire and footwear requirements, no recording where prohibited, and care for studio property. We may remove or suspend anyone who violates rules, is disruptive, or endangers others.
10. Media, recordings, and promotional use
Classes may be photographed or recorded for safety, training, or promotional purposes. By entering the studio or participating in events, you grant us a non-exclusive right to use your image and likeness in connection with the studio. You may opt out by notifying staff before class where feasible. For minors, guardian consent is required.
11. Intellectual property
All content on the site and in our materials, including logos, choreography notes, class descriptions, and media, is owned by us or our licensors. You may not copy, post, distribute, or create derivative works without permission. Your user-generated content remains yours, but you grant us a license to use it to operate and promote the services.
12. Third-party services
We use third-party services such as payment processors, authentication providers, hosting, scheduling, and email delivery. Your use of those features may be subject to the providers’ terms and privacy policies.
13. Disclaimer of warranties
The services are provided on an "as is" and "as available" basis. We disclaim warranties and conditions to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from or related to your use of the services. Our total liability for any claim will not exceed the amount you paid to us for the service giving rise to the claim in the three months before the event.
15. Indemnity
You agree to indemnify and hold us harmless from claims and expenses, including legal fees, arising from your misuse of the services, violation of these Terms, or infringement of third-party rights.
16. Governing law and venue
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. You agree to the exclusive jurisdiction of the courts of Ontario, seated in or nearest to Waterloo, for any dispute that is not subject to informal resolution.
17. Changes to services
We may modify or discontinue classes, schedules, or features. If we make a material change to paid services, we will provide notice in advance where required.
